There is information that the High Anti-Corruption Court has released Oleg Maiboroda, the CEO of "Ukrbud Development," and former chief architect of Kyiv, Serhiy Tselovalnyk, from criminal liability. Additionally, the court has closed their criminal case due to the expiration of the statute of limitations.

This became known thanks to the authors of the Telegram channel "All Moves Recorded."

"Oleg Maiboroda, head of LLC 'Ukrbud Development,' who was threatened with death by his business partner Max Mykytas, has been relieved of one of his criminal cases – the episode concerning the construction of a parking lot on the grounds of Kyiv school No. 130 instead of a swimming pool. The High Anti-Corruption Court closed the case due to the expiration of the statute of limitations (10 years)," the channel's authors report.

The defense attorneys stated that the events in this case occurred from March 29, 2013, to November 25, 2014, meaning that the time of the socially dangerous consequences is November 25, 2014. Thus, on November 25, 2024, the 10-year period since the end of the crime attributed to the defendants will have expired.

The case involves abuse of power, which is a serious crime with a statute of limitations of 10 years. Therefore, the defense requested the release of the defendants from liability and the closure of the criminal proceedings.

It should be noted that according to the prosecution, in 2002, the Kyiv City Council leased land plots in the center of the capital to a limited liability company. The company was supposed to construct a residential building with an integrated swimming pool for secondary school No. 130. To protect the interests of the school regarding the construction of the pool, in 2005, the Holosiivskyi District Council, secondary school No. 130, and the LLC signed a cooperation agreement within the framework of the project implementation.

According to its terms, the LLC constructed the shell of the residential building along with the auxiliary premises for the pool, but in 2008, it halted construction due to a lack of funds. Under these conditions, the LLC entered into an investment agreement with another construction company. According to this agreement, both the LLC and the construction company were obliged to jointly complete the project.

However, in July 2013, as the investigation revealed, the director of the Department of Urban Development and Architecture of the Kyiv City State Administration (former chief architect) Serhiy Tselovalnyk, acting in collusion and in the interests of the construction company director, issued urban planning conditions and restrictions on construction. Instead of building a swimming pool for secondary school No. 130, they proposed the construction of a multi-level parking lot on the school grounds.

Subsequently, without the knowledge of the school and the Holosiivskyi District Council, the construction company built a parking lot in place of the pool and profited from the sale of the illegally constructed parking spaces.
