New attempts at raider capture of the Scientific and Production Center "Borshchagivsky Chemical-Pharmaceutical Plant" ("BHFZ" (eng. BCPP)) have come to light, which are clearly linked to its shareholder and market competitor in the pharmaceutical sector – the Pharmaceutical Company "Darnitsa". However, those monitoring the pharmaceutical market know that attempts to "swallow" the enterprise have been ongoing since 2015, when "Darnitsa" acquired 29.95% of the shares of "BHFZ", which were in the communal ownership of the territorial community of Kyiv – while the Antimonopoly Committee of Ukraine "failed to notice" alarming signs of monopolization in the industry.

It is possible that this was facilitated by the fact that the management of "Darnitsa" was close to the former authorities and enjoyed their protection. After all, the CEO of the pharmaceutical company, Gleb Zagoriy, was elected to parliament on the lists of the Petro Poroshenko Bloc, while a lawyer close to Poroshenko, Alexey Filatov, took the position of deputy head of the Presidential Administration, whose responsibilities included the "reform" of the judiciary, which in practice meant staffing. Moreover, Filatov had friendly ties with Prosecutor General Yuriy Lutsenko and "family ties" with the First Deputy Chairman of the Antimonopoly Committee, Maria Nizhnik, so the raiders of the Borshchagivsky plant had reliable "cover" for many years.

The change of power in the country deprived Zagoriy of this "cover", but the installed reliable judges, powerful media resources, and ambitions remained. Alexey Filatov and Maria Nizhnik left public service and returned to the law firm "Legal Firm "Ekvo"", which immediately raised material claims for a staggering 200 million hryvnias against the management and key shareholders of BHFZ, allegedly due to inflated purchasing prices for active ingredients. In fact, the court in case No. 910/4707/21 ended with nothing: representatives of the Borshchagivsky plant proved in court (which was broadcast live) that the prices for APIs were identical or even several times lower than those supplied by other companies, while representatives of "Darnitsa" misled the court. The lawyers of "Ekvo" also failed to paralyze the company's activities with numerous statements/complaints to the National Police: this year, both criminal proceedings No. 12021100000000607 dated 09.07.2021 and No. 05 ERDR dated 22.11.2021 were closed due to the absence of signs of a criminal offense, supposedly regarding unlawful actions by the plant's management.

Having failed in Ukraine, representatives of "Darnitsa" and Gleb Zagoriy moved their lawsuits to Switzerland last year, where they attempted to seize primary accounting documents, financial reports, contracts, bank statements, etc., filing a lawsuit supposedly on behalf of the BHFZ company. However, it soon became clear that lawyer Antonya Mottyrini had no powers to act on their behalf, and American citizen, lawyer Ned Bill was guided by a contract concluded with... the law firm "Ekvo" of Yevgeniy Levitsky, according to which control over the company's assets in Switzerland was needed by "Darnitsa" to "guarantee the future execution of a favorable court decision".

Isn't it strange how a lawyer hiding from mobilization abroad knows about a yet-to-be-resolved court decision? However, knowing the connections of Zagoriy, Filatov, and Nizhnik, we can guess where it comes from. It is evident that the Borshchagivsky pharmaceutical plant is facing new attempts at raider capture. We can only hope that these will be as unsuccessful as the previous ones.
